COLOMBO (News 1st) – State Minister Diana Gamage had filed a petition claiming that Opposition Leader Sajith Premadasa and Ranjith Madduma Bandara holding membership and positions of the Samagi Jana Balavegaya is against the constitution of the party.Accordingly, both Sajith Premadasa and Ranjith Madduma Bandara were ordered by a Colombo District Court to appear in court on the 25th of January 2023.State Minister Diana Gamage had filed the petition via President's Counsel Uditha Igalahewa with the Colombo District Court and noted that Sajith Premadasa and Ranjith Madduma Bandara continue to remain as members of the United National Party.As evidence, Diana Gamage had produced an affidavit from the General Secretary of the United National Party, and a judicial process that Ranjith Madduma Bandara had taken to challenge disciplinary action by the UNP, as evidence material in her petition.She says that article 3 (3) of chapter 3 of the SJB constitution notes that if a party member holds membership of another party, he or she will lose the membership of the Samagi Jana Balavegaya.She requests the court to deliver a ruling that both Sajith Premadasa, and Ranjith Madduma Bandara holding membership of the SJB, and holding the posts of Leader and General Secretary of the SJB, are illegal.Diana Gamage has also requested an order suspending those from holding the said positions under the examination of the petition is complete.

COLOMBO (News 1st) – Parliamentarian & Field Marshal Sarath Fonseka told Parliament on Friday (2) that the project to dig trenches as a solution to the Human-Elephant Conflict is a failure.Sarath Fonseka said that a ruling party MP from Ampara had proposed for trenches to be dug as a solution to the human-elephant conflict.Fonseka said warned that digging up a trench that is 10 feet wide and 10 feet deep would pose a direct threat to the river systems in the country.He added that even though the Department of Wildlife Conservation had not approved the project on technicalities, a 55-kilometer-long trench has been dug up, and the allegation is that the project is being used to illegally remove soil and sand.His comments were met with strong opposition from the ruling party in the house.

COLOMBO (News 1st) – Sri Lanka's Cabinet approved a hike in electricity tariffs under two steps in January and June 2023.A statement from Sri Lanka Parliament said that although the electricity tariff has been increased in the past, it is not sufficient to cover the loss of the electricity board and thus, the request to increase the electricity bill has received cabinet approval. This was disclosed at the Sub Committee on Identifying the Short & Medium-Term Programmes related to Economic Stabilization of the National Council held on Wednesday (29).Accordingly, the Cabinet has approved increasing the electricity tariffs under two steps in January and June 2023.

COLOMBO (News 1st) – The Supreme Court ordered the Inspector General of Police to establish a committee to formulate a regulatory framework for Police officers to follow when conducting inquiries into disputes. The Supreme Court gave this direction as part of an interim order issued when an incident where a senior police officer had obstructed an Attorney at Law from performing his duties was taken up in court. According to the petitioner, an Attorney, he had visited the Boralasgamuwa Police on the 13th of November 2021 to represent his client at the police station. The petitioner stated, while representing his client, Senior Superintendent of Police K.S.K Rupasinghe had demanded that he step out of the room. The petitioner had refused to do so. The SSP had then proceeded to threaten the Attorney claiming he will be thrown into a cell.

COLOMBO (News 1st) – Sri Lankan Opposition Leader Sajith Premadasa told Parliament on Friday (24) that he did not apply for the post of Prime Minister, during the tenure of Gotabaya Rajapaksa.Sajith Premadasa said that the Former President repeatedly requested him to accept the post of Prime Minister, and four conditions were put forward to Rajapaksa for the establishment of an interim short-term government.• President must resign from his position during a stipulated minimum period of time;• Implement and enact the 19th constitutional amendment within a period of two weeks, with the support of all political parties;• Implement the provisions in the Constitution within a minimum time period to abolish the executive presidency; and• Call for a parliamentary election to allow the public to form a permanent government after implementing the constitutional amendments and rebuilding the community life and ensuring the rule of law.Sajith Premadasa said he wrote to then-President Rajapaksa citing these four conditions to accept the post of Prime Minister, and did not request or apply for the post of Prime Minister.Sajith Premadasa was responding to a comment made by President Ranil Wickremesinghe in Parliament on Thursday (24).'Our Opposition Leader also said today that I asked for this presidency.  COLOMBO (News 1st) – Sri Lanka's Minister of Justice, Prisons Affairs and Constitutional Reforms Wijeyadasa Rajapakshe said calling for applications to appoint civil society members to the Constitutional Council is not in accordance with the 21st Amendment to the Constitution.Recently the Sri Lanka Parliament said that applications are called for the appointment of Members, who are not members of Parliament to the Constitutional Council proposed by the 21st Amendment.Applications are called from persons of eminence and integrity who have distinguished themselves in public or professional life and who are not members of any political party, to be considered for the appointment as Members of the Constitutional Council which is to be established under the provisions of Article 41A of the Constitution of Democratic Socialist Republic of Sri Lanka, said the statement.However, Justice Minister said that the 21st Amendment to the Constitution does not allow for such appointments via application, and the appointment of the civil society members to the Constitutional Council should be done by the Speaker, Prime Minister, and the Opposition Leader.

COLOMBO (News 1st) – Maldives Speaker of Parliament Mohamed Nasheed attending the 27th Conference of the Parties to the United Nations Framework Convention on Climate Change or COP 27 as a member of the Sri Lanka delegation sparked a regional controversy.Sri Lanka's opposition lawmakers questioned the basis of the Former Maldives President accompanying the Sri Lankan delegation, and who is bearing the cost for his travels.Former Attorney General Dr. Mohamed Munavvar has criticized former President and Speaker of Parliament, Mohamed Nasheed for attending the 27th Conference of the Parties to the United Nations Framework Convention on Climate Change (COP 27) as a member of the Sri Lankan national delegation.Nasheed is also a climate advisor to the country’s President, Ranil Wickremesinghe.In a tweet Dr Munavvar posted, he questioned Speaker Nasheed’s loyalty to Maldives while he is a statesman paid by the taxpayers money.The former AG’s remarks against Speaker Nasheed comes while some local media reports have stated that the Speaker was not invited to take part in the Maldivian delegation to COP27 after which the former President and Speaker of Parliament decided to attend the COP27 with the Sri Lankan delegation.

Sri Lanka, which is under an ongoing economic crisis, is headed for another major turbulence as the country will not be able to secure the much-needed IMF loan in December as its ally and debtor China is yet to initiate a dialogue on debt restructuring with Colombo.A report in the Hindustan Times quoting financial analysts based in Washington said that Sri Lanka will miss the IMF deadline and will have to wait till March next year to secure a loan of $2.9 billion, as Beijing was involved in the 20th National Party Congress.The next meeting of the IMF executive board is in March 2023, Sri Lanka will most likely have to wait until then for IMF Board approval, and access to the funds.Why is China's involvement so important to access IMF funds?Sri Lanka is now considered a country that defaulted on its external debt because the island nation lacked foreign reserves for debt servicing.According to the Central Bank of Sri Lanka and the Finance Ministry, Sri Lanka's total debt was $36 billion at the end of 2021.Of this total debt, Colombo owes some 52% in bilateral credit to China, 19.5% to Japan, and 12% to India.One of the main conditions for Sri Lanka to tap the USD 2.9 Billion funding from the International Monetary Fund is debt reconciliation and restructuring.Bilateral means transactions between two countries, and there is an institution that operates with the support of the International Monetary Fund to talk about bilateral debt, and this is called the Paris Club.Sri Lanka has obtained a large number of loans from Japan, India, and China, and among them, only Japan is a member of the Paris Club.India is openly supporting Sri Lanka's engagement with the IMF, and avenues are open for Sri Lanka to discuss debt

COLOMBO (News 1st) – The Canadian business community has accorded support to the development of Sri Lanka's economy to overcome the economic crisis.This was accorded at the meeting on Thursday (03), between Mahinda Yapa Abeywardana, Speaker of Parliament and a group of Canadian business leaders in Parliament. The Canadian business community said that they hope to increase their friendship with Sri Lanka and also expressed their desire to support the young entrepreneurs in Sri Lanka to build their enterprises.Mahinda Yapa Abeywardana, Speaker of Parliament addressing the delegation, said that they will work expeditiously to bring about the development of the country. The speaker showed that the support of Canada's business leaders is also important for this purpose and pointed out the need for cooperation between the two sides.Furthermore, the speaker told the delegation present that an Overseas Sri Lankan Coordination Secretariat to help expatriates is in the process of being established in Sri Lanka and the necessary discussions are currently underway and that he hopes to get the support of each party for economic development.The Minister of Education and Leader of the House of Parliament, (Dr.) Susil Premajayantha was also present at this event and he pointed out the need to increase the friendship between the two parties.

(Hindustan Times) – Sri Lanka will miss the December deadline for securing an IMF loan as the main bilateral debtor China was involved in the 20th party congress and had little time for holding debt restructuring talks with Colombo, reported the Hindustan Times.The next meeting of the IMF executive board is in March 2023.According to financial analysts based in Washington, Sri Lanka likely will miss the December IMF deadline and will have to wait for March 2023 to secure a USD 2.9 billion loan from the lending institution in eight equal tranches.In the meantime, the Sri Lankan debt has increased further due to forex depreciation, deep recession, and burgeoning fiscal deficit. Since the end of 2021, inflation has considerably eroded the real value of domestic debt.While debtors India and Japan have already initiated a dialogue with Colombo on debt reconciliation and restructuring, China is still to engage in the dialogue as Beijing was involved in the 20th National Party Congress and had little time for client state Sri Lanka. The total debt of the island nation was USD 36 billion at the end of 2021. Of this, Sri Lanka owes USD 7.1 billion to China or 20% of its debt.

COLOMBO (News 1st) – The Sri Lanka Podujana Peramuna marked its sixth anniversary on Wednesday (2) and Parliamentarian Namal Rajapaksa who participated in a media briefing at the party headquarters said that no one can secure governance through violence.The MP who represents the SLPP said the party always followed democratic means and always considered the welfare of the Sri Lankan people when making decisions as a party.He said due to these policies the SLPP was able to secure power across a majority of the Pradeshiya Sabhas and also a 2/3 majority in the Sri Lankan parliament following the Presidential election victory with 6.9 million votes."We need to modernize our party. As a party that always follows democracy, we need to identify the issues faced by our people and then modernize our party accordingly.

COLOMBO (News 1st) – Amnesty International noted that it is concerned over Sri Lanka Police denying permission for the protest by trade unions, students and political parties. Protestors must not be required to obtain permission from authorities, to exercise basic human rights such as the right to peaceful assembly.The reasons for denying permission for the protest quoted by the Police do not amount to legitimate restrictions against peaceful assembly as provided by international law, said Amnesty International.It added that the UN Special Rapporteur on Freedom of Peaceful Assembly and Association has stipulated that "the free flow of traffic should not automatically take precedence over freedom of peaceful assembly."Amnesty International South Asia said that urban spaces are not only an area for circulation but also spaces for participation. Many assemblies, by nature, involve a certain level of disruption to ordinary life or the rights of others.It added that nevertheless, disproportionate restrictions to protest, jeopardise the right to freedom of expression.Freedom of peaceful assembly is a right, not a privilege.

COLOMBO (News 1st) – Journalist Tharidu Jayawardena had filed a private complaint against ASP Nalin Dilruk, and SSP Roshan Dias for alleged obstruction caused during a protest on the 10th of October 2022 in Colombo.The Attorney General on Tuesday (1) had filed an ex-parte motion to call for the matter, and on Wednesday (2) counsel appearing for the complainant expressed their objections over this move.Appearing for the complainant President's Counsel Saliya Peiris told the court that the Attorney General is not a person with special privileges.The President's Counsel pointed out that the Attorney General was not a party to the private plaint filed against two police officers, and noted that summoning the case via an ex-parte motion to obtain orders sets a negative precedent.He added that if the Attorney General wanted to call for the case via a motion, the Attorney General must inform the complainant or his counsel.President's Counsel Saliya Peiris stressed that Senior State Counsel Saminda Wickrama appearing for the Attorney General had concealed the fact that he did not inform the complainant or the counsel from the Magistrate, and presented facts over the matter.He informed the court that he was only made aware that the case was called up via a motion on Tuesday (1) following media reports on the matter, and that the counsel for the state had told the court that the complainant had made false submissions to the court.President's Counsel Saliya Peiris stressed that the complainant or the counsel have never produced any false fact to the country, and had never misled the court.He pointed out that the submissions made by the Attorney General's Department were published in the media, and though the Attorney General had

COLOMBO (News 1st) – Speaker Mahinda Yapa Abeywardena has instructed officials to immediately investigate the misuse of MP quarters.The speaker mentioned that there have been constant complaints from various parties that some of the official residences in the Malabe MP housing complex have been misused.Accordingly, seveal complaints have been received that former members of Parliament who are not currently representing the Parliament have been staying in some MP quarters for a long time.In some complaints, it has been stated that staff members and security guards are also staying at some quarters reserved for MPs.The Speaker says that he has instructed the responsible officers to take into consideration such complaints and immediately investigate and report the matter.An MP quarters consists of 900 square feet equipped with 03 bedrooms, a kitchen, a living room, a dining room, a staff toilet and parking space.The Madiwela MP Housing Complex consists of 120 housing units which are given to them on a rental basis.

COLOMBO (News 1st) – The State Minisrer of Finance Shehan Semasinghe says that he hopes to reach an agreement with regard to the financial assurance by creditors, which is expected by the International Monetary Fund during the negotiations that will begin on 3rd November.The State Minister said that although Sri Lanka's bilateral creditors such as China, India and Japan have verbally agreed to assist the country in debt restructuring, however, the IMF needs proper financial assurance in time for the negotiations.The Minister said that they are attemtpting to obtain the approval of the IMF board as soon as possible. The minister made these comments during an inquiry made by Newsfirst regarding the second phase of the official-level negotiations to be initiated with the International Monetary Fund.The minister stated that no moves will be made to bypass the Parliament in dealing with the International Monetary Fund.Minister Semasinghe added that no parties other than the Ministry of Finance and the Central Bank of Sri Lanka have been informed with regard to the staff level agreement with the IMF.

COLOMBO (News 1st) – A petition has been filed at the Supreme Court on Friday (28) seeking a ruling that the Inland Revenue Amendment Bill is in violation of the Constitution of Sri Lanka.The petition has been filed by Chartered Accountant Prasad Dassanayake.Dassanayake has pointed out in the petition that some of the clauses contained in the draft will damage the business sector, especially the import and export sector, and by imposing a heavy tax burden, the relevant sector may collapse entirely.The petitioner further requests that its articles be passed by a two-thirds majority vote in Parliament or via a referendum.Earlier, three parties filed petitions at the Supreme Court against the Inland Revenue Amendment Bill submitted by the government to Parliament on 21st October.

COLOMBO (News 1st) – The Bar Association of Sri Lanka says that the enactment of the 21st Amendment must not be used as an excuse or mechanism to discontinue Chairpersons and members of Commissions whose services helped establish public faith in such Institutions. The Bar Association went on to note that the 21st Amendment to the Constitution regrettably does not completely restore the status quo ante which prevailed prior to the 20th Amendment to the Constitution and does not place adequate checks and balances on the powers of the Executive President. It noted that the 20th Amendment to the Constitution rolled back the checks and balances which were introduced by the 19th Amendment on the exercise of executive power.The Bar Association of Sri Lanka calls upon the President, Prime Minister, Speaker, Leader of the Opposition, and all political parties represented in Parliament, to firstly ensure the integrity of nominations to the Constitutional Council and to ensure that such nominations are devoid of partisanship and in a manner that will inspire public confidence.The BASL noted that for this purpose, it is important to ensure that the non-ex-officio members of the Constitutional Council appointed from among Members of Parliament and from among non-Members of Parliament be done in a transparent and open manner and to also ensure that those appointed will be acceptable to the members of the public and be persons of the highest integrity and reputation.
