NEW YORK - Daniel Penny, the 24-year-old Marine veteran at the center of Jordan Neely's choking death aboard a subway train last week, has turned himself in to police to face a criminal charge over the incident.Neely, who was homeless, died back on May 1 after Penny allegedly held him in a chokehold for several minutes.According to witnesses, Neely was yelling at and harassing passengers on the train before he was subdued by Neely and others, and ultimately died.Manhattan prosecutors say they will bring criminal charges against a man who used a deadly chokehold on an unruly passenger aboard a New York City subway train.The Medical Examiner's office later ruled Neely's death a homicidecaused by compression on the neck.Penny faces a charge of second-degree manslaughter, which could carry a jail term of up to 15 years."Second-degree manslaughter means that they're charging him with having recklessly caused the death. Recklessly means that he was operating with a substantial and justifiable risk of causing death to another person," explained Andrew Cherkasky, a former federal prosecutor."I think that some people are going to be upset about this that it wasn’t more serious.

PENNSYLVANIA - Two high schools in Pennsylvania closed their doors out of an abundance of caution and switched to remote learning on Friday due to threats, officials say. Students and staff at Pennsbury and Neshaminy high schools will be remote after both schools received threatening messages. An announcement posted on the Neshaminy High School website says the school received tips containing screenshots from social media alleging a threat against the school on Friday. Middletown Township Police launched an investigation to find the source of the threat, but school officials say the high school switched to remote learning out of an abundance of caution. This announcement posted to the Neshaminy High School website details information about a threat made against the school.  Officials at Pennsbury High School say the school also received a threat against the school for Friday. RELATED: State Police investigating series of 'false' threats made against schools across PennsylvaniaOfficers with the Falls Township Police Department were notified, and the department is investigating the source of the threat, according to a school announcement. Students are set to undergo asynchronous instruction.  This message announcing remote learning was posted on the Pennsbury High School website on May 12, 2023.

PHILADELPHIA - Homicide detectives in Philadelphia are investigating a shooting that left one man dead on Friday morning. According to authorities, the shooting erupted on the 800 block of Hutton Street in the city's Belmont section around 2:15 a.m. Chief Inspector Scott Small said police responded to the scene for reports of gunshots and found a 59-year-old man sitting in the driver's seat of a Chevy. Police say the man was unresponsive with gunshot wounds to his neck and chest. MORE LOCAL HEADLINESThe victim was transported to Presbyterian Hospital, where he was pronounced dead, officials say. According to investigators, the window of the vehicle was down when they arrived on scene. The victim lives several blocks away from the fatal shooting scene, police say. The investigation is active and ongoing.

NEWARK, Del. - A Georgia woman, accused of Cruelty to Animals by Newark, Delaware police, has turned herself in, while a dog in her care died from injuries sustained April 28.Syniah Percell, a 25-year-old Marietta, Georgia resident, turned herself into Newark Police May 9.According to officials, police were called to an apartment on the 100 block of Thorn Lane on the report of an injured dog.A resident left Percell in charge of the resident's Yorkshire Terrier while out of the apartment.When the ower returned home, the dog was "acting strange, walking oddly and had a bruise on its body," police say.MORE HEADLINES:The dog was then taken to a veterinarian and the vet found the dog suffering from severe injuries.During the police investigation, video was found that the friend left in charge, identified as Percell, abused the dog while in her control.The dog died from the injuries sustained.Percell turned herself in and faced a judge by video.

Jamie Foxx suffered a mysterious health scare one month ago and is reportedly still hospitalized in Atlanta. PHILADELPHIA - A Philadelphia man accused of shooting at another driver during a road rage incident on I-95 was taken into custody on Thursday. Investigators believe Chauncy Salmo Noel was behind the wheel of a white Volvo when he was involved in a dispute with another driver near the Bartram Avenue exit on May 1. During the confrontation, it's alleged that Noel fired one shot that grazed the driver of another vehicle in the arm and continued driving north on I-95 past the Broad Street exit. MORE LOCAL HEADLINESThe Pennsylvania State Police say they located Noel's Volvo a day later outside a property in Southwest Philadelphia and executed a search warrant on the vehicle. Noel was taken into custody on Thursday after police say investigative efforts identified him as the driver of the Volvo at the time of the shooting. A search warrant of his Southwest Philadelphia property uncovered two pistols and a rifle, according to police. No charges were immediately shared following Noel's arrest.

PHILADELPHIA - A woman has been arrested and charged with helping two prisoners escape from a Philadelphia prison earlier this week, police say. According to Deputy Commissioner Frank Vanore Jr., 21-year-old Xianni Stallings helped Ameen Hurst, 18, Nasir Grant, 24, escape the Philadelphia Industrial Correctional Center.  Related A manhunt is underway for two inmates who officials say left their cell and escaped a Philadelphia prison through a hole in a perimeter fence. Authorities say a recorded jail phone call from one of the men before the escape helped investigators make the connection to Stallings. Philadelphia District Attorney Larry Krasner says the woman is facing multiple charges in connection to the escape. The DAO requested bail be set at $2 million, but a judge set it for $500,000. This is a developing story.

PHILADELPHIA - Mother's Day is a celebration for women to celebrate their role as mothers, but for many women in Philadelphia, the day is a solemn one. As Philadelphia continues to battle its ongoing gun crime crisis, many women are mourning the loss of children who died as a result of violence. FOX 29's Steve Keeley spoke with a group of mothers treated to a spa day by Glossy Nails in North Philadelphia as they prepare to mark an emotional Mother's Day without their children. Glossy Nails Boutique and Sixx Degrees Media partnered to give the group of mothers the special day. Michelle De Jesus lost two sons to gun violence and she says Mother's Day never gets easier. She says she lost one son in the month of July and the other son in August, making the summer months difficult for her. "I know God wanted his sons so he took them, but the guns have got to stop. PHILADELPHIA - The Philadelphia Police Department has made an arrest in a deadly hit-and-run in Center City, according to authorities. Dominique Murphy, 37, of West Philadelphia, was arrested and charged with involuntary manslaughter, homicide by vehicle, aggravated assault by vehicle, and related charges after being taken in as a person of interest, police announced Thursday morning. Dominique Murray, 37 According to authorities, Murray was allegedly operating a dark gray Jeep with its headlights off on Tuesday night, speeding down JFK Boulevard in the wrong direction around 10 p.m. Officers followed the vehicle, which then sped onto the 1300 block of Arch Street, striking a woman and one of her three children as they were crossing the street. After striking them, the officers stopped to render aid and the Jeep continued, fleeing the scene. MORE LOCAL HEADLINESThe woman, identified as a 38-year-old, suffered severe head trauma and was initially placed in critical condition.

PHILADELPHIA - The Philadelphia Police Department is asking for the public's help in identifying two suspects wanted in connection with a shooting. According to police, the shooting occurred on the afternoon of April 23 on the 3800 block of North 13th Street in the Hunting Park section of the city. Authorities say two masked men armed with semi-automatic weapons pulled up on the two victims who were in a car on the street. Surveillance video released by police shows the moments the two suspects fired on the vehicle, drove to another street and continued firing in the direction of the victims. MORE LOCAL HEADLINESAccording to officials, a 40-year-old woman and a 24-year-old man were struck in the face and throughout their bodies, leaving them in critical condition. The suspects then fled the scene in a gray late model Toyota Camry, which has since been located by police, authorities say. Anyone with information on the shooting is urged to contact Philadelphia police at 215-686-8271 or submit an anonymous tip here. 

LAKELAND, Fla. - A Lakeland police officer is recovering in the hospital after he was shot by a 13-year-old suspect, who was also shot several times by another officer, authorities said. Officials with the Lakeland Police Department and Polk County Sheriff's Office swarmed Lincoln Avenue Wednesday afternoon, but investigators said it all started with a drive-by shooting at Simpson Park.Polk Sheriff Grady Judd and Lakeland Police Chief Sam Taylor said Officer Jamie Smith heard a shot fired at the park while he was investigating a separate call in the area at around 5:15 p.m. He was able to find and pursue the suspect's vehicle, a Dodge Avenger, and tried to stop it. Polk County Sheriff Grady Judd and Lakeland Police Chief Sam Taylor provided an update on an officer-involved shooting that happened on Lincoln Avenue Wednesday afternoon.

While waiting for the sheriffs to arrive, Lynn-Phipps became unresponsive and convulsive, so police used Narcan to treat him.
