A smoker won a £1,000 payout after being sacked for having a cigarette in the wrong place during his shift at a water bottling plant.

Richard Andrew, 45, was meant to only light up in the "smoking shed" at spring and mineral water plant Montgomery Water. But he was spotted on CCTV four times in one day smoking next to the water tank - and had to use his electronic key fob to gain access to get in.

He was sacked by the company - which supplies supermarkets such as the Co-op and Tesco - but he claimed he was not the person seen in the footage.

A tribunal has since ruled the company were wrong to sack him straight away - and he will be paid compensation for unfair and wrongful dismissal.
