Charles Peruto Jr. said Monday that 36-year-old Paul Burkert of Reading was being "getting pummeled" before the shooting early Thursday outside Pat's King of Steaks in south Philadelphia.Burkert is charged with murder, reckless endangering, evidence-tampering, conspiracy and weapons offenses in the shooting death of 23-year-old David Padro of Camden, New Jersey.Peruto said his client was left with cuts on his face and his own blood in his hair, face, chest and clothing.

SOUTH PHILADELPHIA - Authorities on Friday identified a 23-year-old New Jersey man who police say was shot and killed during a fight outside of Pat's Steaks in South Philadelphia. According to police, David Padro, a Camden resident, was shot in the lower back near the popular Philadelphia cheesesteak location on East Passyunk Avenue just before 1 a.m Thursday.Officers drove Padro to Jefferson University Hospital where police say he died shortly before 1:30 a.m.Investigators were told by witnesses that Padro was shot by another customer who fled in a van.
